1. Parties to the Agreement
This agreement is entered into between Lake Drive LOOP (the "Company") and the individual identified as the Participant (including Parent or Legal Guardian if the Participant is under 18 years of age). By proceeding with the rental, you acknowledge that you are of legal age or have obtained necessary consent to bind yourself or the minor to these terms.
2. Acknowledgement of Risks
General & Activity Specific Risks
Participant acknowledge that operating an e-bike involves inherent dangers, including but not limited to:
- Collision with pedestrians, motor vehicles, or other cyclists.
- Loss of control due to mechanical failure or road hazards (potholes, gravel, debris).
- Risks associated with the electric motor assist (sudden acceleration or power cut-offs).
- Physical exertion leading to injury or cardiovascular distress.
Waterfront & Tourist Area Hazards
Special risks apply to the Georgina waterfront region, including unpredictable lake winds, sand on pathways, and high-density tourist traffic. Participant assumes all risks related to navigating these specific environments.
3. Eligibility & Safety Requirements
Age Requirement: All operators must be at least 16 years of age (with parent/guardian signature) or 18+ to sign independently.
Mandatory Helmets: Helmets are strictly mandatory for all riders in accordance with Ontario Law.
Identification: A valid government-issued photo ID is required to initiate any rental period.
Ontario Laws: Operators must comply with the Highway Traffic Act and all local Georgina municipal bylaws.
4. Passengers
Passengers are only permitted on e-bikes specifically designed for multi-rider use.
- Operator must be 18+ to carry a passenger.
- Passenger must be at least 16 years of age.
- Both operator and passenger MUST wear certified helmets at all times.
The operator accepts full legal responsibility for the actions, conduct, and safety of any passenger. The Company shall not be liable for injury, loss, or damage sustained by any passenger. Each passenger must sign a separate waiver prior to riding.
5. Individual & Group Bookings
For group bookings, the "Group Organizer" (the individual making the payment) accepts primary responsibility for all equipment and actions of the group participants. However, every participant in the group must sign a separate waiver before operation.
6. Accessory Rentals
Rentals of accessories (locks, baskets, chargers) are the sole responsibility of the Participant. Loss, theft, or damage to accessories will result in replacement fees deducted from the security hold. The Participant assumes all risks associated with the use or misuse of accessories, including risks arising from equipment malfunction or improper fit.
7. Equipment Condition & Use
Operational Limits
- Terrain: E-bikes are strictly prohibited on sand, beaches, or deep water. Operation is limited to paved roads and designated trails.
- Tracking: All bikes are equipped with active GPS tracking for recovery and safety monitoring.
Maintenance & Care
- Inspection: Participant must inspect equipment before use and report defects immediately.
- Battery: Do not attempt to charge or modify the battery system. Use only supplied chargers and never expose battery to water.
Participants must not leave e-bikes unattended while swimming or engaging in water activities unless properly locked in an approved location. Participant agrees to lock the e-bike when unattended, park only in safe permitted areas, avoid overnight outdoor storage unless approved. Failure to secure equipment resulting in theft may result in replacement charges. The Participant assumes full responsibility for loss or theft occurring during rental periods.
8. Prohibited Use
The Participant agrees NOT to:
- ride off-road unless permitted.
- tow objects.
- carry more than 1 passenger.
- exceed manufacturer weight limits.
- perform stunts or racing.
- allow unauthorized riders.
- modify equipment.
- permit any other person to operate the e-bike unless that person has signed this Agreement.
- operate e-bikes on docks, piers, or marinas.
- operate e-bikes on frozen surfaces, ice-covered roads or trails.
9. Breakdown Procedures
In the event of a mechanical failure or flat tire, stop riding immediately. Continuing to ride on a flat tire or damaged rim will result in additional damage fees. Contact Lake Drive LOOP Support through the app for roadside assistance instructions.
10. Damage, Loss & Fees
Repair Costs
Participant is responsible for the full retail cost of professional repair or replacement of damaged components.
Total Loss/Theft
Unrecovered stolen bikes or totaled units will be billed at full replacement value ($2,500+ CAD).
Administrative Fee
A $50 processing fee applies to all insurance claims or significant damage reports.
11. Payment & Security Hold
A $250 CAD security hold is placed on your credit card at the start of every rental. This hold is released upon inspection of the returned bike, provided no damages or late fees occurred.
12. Waiver, Release of Liability & Indemnity
BY SIGNING THIS DOCUMENT YOU ARE WAIVING CERTAIN LEGAL RIGHTS, INCLUDING THE RIGHT TO SUE OR CLAIM COMPENSATION FOLLOWING ANY INJURY PLEASE READ CAREFULLY!
13. Governing Law & Severability
This Agreement shall be governed by and construed in accordance with the laws of the Province of Ontario. If any portion of this agreement is found to be void or unenforceable, the remaining portions shall remain in full force and effect.
14. Acknowledgement & Signature
By signing below (digitally or physically), you acknowledge that you have read, understood, and agreed to all terms of this E-Bike Rental Agreement and Release of Liability.
