E-Bike Rental Agreement,

3. Acknowledgement of Risks

I acknowledge that operating an e-bike involves inherent risks, including but not limited to: collision with pedestrians, vehicles, or cyclists; loss of control due to mechanical failure or road hazards; risks associated with electric motor assist; physical exertion; and the specific hazards of the Georgina waterfront area, including lake winds, sand on pathways, and high tourist traffic density.

I also acknowledge that I am solely responsible for assessing whether weather and road conditions are safe before and during my rental, and that I will discontinue riding if conditions become unsafe. The Company does not guarantee route safety or accessibility.

4. Equipment & Passengers

I will inspect equipment before use and report any defects immediately. I will lock the e-bike when unattended and park only in permitted areas. I accept full responsibility for loss or theft during the rental period.

Passengers are permitted only on designated two-seat models. Operators must be 18 or older to carry a passenger. Passengers must be at least 16 and must wear a certified helmet. The operator accepts full legal responsibility for any passenger.

5. Prohibited Use

I agree NOT to: ride off-road unless explicitly permitted; carry more than one passenger; exceed manufacturer weight limits; perform stunts or racing; allow any unauthorized person to operate the e-bike; modify equipment; operate on docks, piers, marinas, frozen surfaces, or ice-covered trails; or operate while impaired.

6. Fees & off session authorization

By signing this agreement, you authorize Lake Drive Loop Inc. to charge your saved payment method for: the initial rental fee at the time of booking; any additional time charged at the applicable hourly rate upon return; any late return fees; and any charges for damage, loss, or theft of equipment as described in this agreement. You confirm that you are the authorized holder of the payment method provided and consent to these charges being applied without requiring a separate authorization for each transaction.

Damage, loss, or theft may result in charges up to full replacement value ($2,500+ CAD). A $50 administrative fee applies to insurance claims or significant damage reports. All fees, payment terms, billing disputes, and charge authorizations are governed by the Website & Mobile App Terms of Use, which you have agreed to by using our Platform.

8. Dispute Resolution & Arbitration

The parties agree to first attempt to resolve any dispute through good-faith negotiation. If unresolved within 30 days, either party may initiate binding arbitration administered by the ADR Institute of Canada, Inc. in Toronto, Ontario. Any arbitration shall be conducted on an individual basis only. You expressly waive the right to file a class action or seek relief on a class basis. You may opt out of this arbitration clause by written notice to the Company within 30 days of your first rental. Nothing in this section limits rights that cannot legally be waived under Ontario or Canadian law.

9. Governing Law & Severability

This Agreement is governed by the laws of the Province of Ontario. If any provision is found unenforceable, the remaining provisions continue in full force.
